Terms of service
Last updated 25 October 2026
These terms are an agreement between Lustrio Ltd (company number 17537329, registered office 83 Southgate Way, Dudley, England, DY1 3HN), trading as ClearToDrive (“we”), and the business that creates a ClearToDrive account (“you”). By creating an account you accept them on behalf of your business. ClearToDrive is for businesses only, not consumers.
1. What ClearToDrive does
ClearToDrive helps you collect and track evidence that staff who drive their own vehicles for work hold a valid licence, business-use insurance, vehicle tax and an MOT, and reminds them before these lapse.
ClearToDrive is a record-keeping tool, not a guarantee. We rely on information from your drivers, from you and from the DVLA, and we do not certify that any driver is insured, licensed or legally entitled to drive. You remain responsible for your own duties as an employer, including deciding whether someone may drive for work.
2. Your account
- Keep access to your email account secure, since that is how you sign in.
- Only invite people you have a genuine reason to check, and tell them why you are collecting their details.
- Do not misuse the service, try to access other businesses' data, or interfere with how it runs.
3. Trial, prices and payment
- New accounts get a 14-day free trial with no card needed.
- After the trial, the price is £2.50 per active driver per month, with a minimum of £25 a month, plus VAT if applicable. An active driver is one on your list at any point in the billing month.
- You pay monthly in advance by card. If a payment fails and is not fixed within 14 days, we may suspend the account.
- We will give you at least 30 days' notice by email of any price change.
4. Cancelling
You can cancel at any time and the account stays open until the end of the month you have paid for. We do not refund part months. Before closing, you can ask us for an export of your records. We delete your data within 30 days of closure, as set out in our privacy policy. We may close an account that breaks these terms, telling you why.
5. Data protection
For driver data, you are the controller and we are your processor. We will:
- process driver data only to provide ClearToDrive and on your documented instructions, which are these terms and how you use the service;
- make sure anyone who handles it is bound by confidentiality;
- keep it secure with appropriate technical and organisational measures;
- use only the sub-processors listed in our privacy policy, and tell you before adding a new one so you can object;
- help you respond to requests from drivers exercising their rights, and with any data protection impact assessment;
- tell you without undue delay, and within 48 hours, if we become aware of a breach affecting your data;
- delete or return the data when the account closes; and
- give you the information you need to show we meet these obligations.
You confirm you have a lawful basis for checking your drivers and that you have told them about it.
6. Availability
We aim to keep ClearToDrive available at all times but cannot promise it will never be interrupted, for example during maintenance or if a supplier such as the DVLA is unavailable.
7. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited. Otherwise, we are not liable for loss of profit, revenue or goodwill, or for any indirect loss, and our total liability in any 12 months is limited to the fees you paid us in that period. We are not responsible for decisions you make about whether someone may drive.
8. Changes to these terms
We may update these terms. We will email you at least 30 days before an important change takes effect, and you can cancel before then if you do not agree.
9. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
